Apple, ma davvero?

Ho parlato di recente della mia opinione riguardo le applicazioni di tracciamento delle esposizioni al Covid 19 e dopo alcuni commenti ed alcune chiacchierate con amici o conoscenti ho continuato a pensarci su.

Al momento la mia posizione non cambia. Continuo a tenere l’applicazione installata sul mio smartphone. Nonostante tutto.

Nella mia ulteriore riflessione, ed in seguito al cambiamento da parte di Apple che decide, d’ordine, di abilitare il tracciamento a livello di sistema operativo mi sono sorti dei dubbi.

Per questa ragione sono andato a leggermi la documentazione che riguarda le Exposure API di Apple. Nel caso in cui vogliate dare una occhiata potete andare qui. Qui la cosa si fa interessante perché in quella documentazione si fa riferimento ad un addendum alla documentazione che si trova qui.

Questo documento è molto interessante nel suo contenuto. La parte che mi lascia maggiormente perplesso è questa:

2.1 In order to use the Exposure Notification APIs, You must be a government entity, such as a government health services organization, or a developer who has been endorsed and approved by a government entity to develop an Application on behalf of a government forCOVID-19 response efforts. Entitlement Profile(s) are limited to one (1) Application per country unless the country has a regional approach, or as otherwise agreed by Apple. If You are a developer who has been endorsed or approved by a government entity, You agree to provide documentation to Apple evidencing the authorization and endorsement of the government entity upon Apple’s request.Further, developers endorsed or approved by a government entity must have a written agreement with such government entity that obligates the government entity to abide by the terms of this Addendum and the Developer Agreement.

2.2 You understand that You will need to request an Entitlement Profile on the Apple Developer Program web portal prior to any use of the Exposure Notification APIs. You agree to submit true, accurate, and complete information to Apple regarding Your requested use of the Exposure Notification APIs. Apple will review Your request and reserves the right to not provide You with the Entitlement Profile in its sole discretion, in which case You will not be able to use the Exposure Notification APIs. Apple will not be liable to You for declining Your request to use the Exposure Notification API seven if You have agreed to this Addendum.

2.3You acknowledge and agree that You will not access, or attempt to access, the Exposure Exposure Notification APIs Addendum Page2 Notification APIs unless You have received an Entitlement Profile from Apple. Apple reserves the right to not provide You with the Entitlement Profile,and to revoke such Entitlement Profile, at any time in its sole discretion.

La sostanza è che solo una entità governativa può richiedere l’accesso alle Exposure API e che questo accesso è limitato ad una sola applicazione.

Quindi, cara Apple, fammi capire: sei tu che decidi se io, in qualità di governo sovrano sul mio territorio, posso accedere o meno a quelle API ed, allo stesso tempo, mi dici che con il tuo hardware non ho nessuna possibilità di accedere all’hardware che mi permetterebbe di farlo in autonomia?

E’ ben evidente che a questo punto è Apple che ha controllo sull’operato di un governo e non il contrario come sarebbe sano che fosse. Questa cosa mi manda fuori di testa e credo che sia un tema assolutamente rilevante al di là del tema Covid 19.

Aziende private come Apple, Google, ed in generale tutti i grandi player del mercato high tech, sono oramai entità trans nazionali che esercitano un enorme potere sui consumatori. Quello sopra ne è un esempio eclatante.

Forse sarebbe il caso di cominciare a metterci la testa e fare qualche riflessione.
